Article 1: General provisions

The e-commerce website of DW Shop, a sole proprietorship with its registered office at Brugsesteenweg 378, 8520 Kuurne, VAT BE 0540.894.962, RLE Kortrijk, offers its customers the possibility to purchase the products from its webshop online. These terms apply to dwshop.be, dwshop.fr and dwshop.eu.

These General Terms and Conditions apply to every order placed by a visitor to this e-commerce website. When placing an order through the DW Shop webshop, the Customer must expressly accept these Terms, thereby agreeing to their applicability to the exclusion of all other terms. Additional terms of the Customer are excluded, unless these have been accepted in advance, in writing and expressly by DW Shop.

Article 2: Price

All prices stated are expressed in euros. For consumers, prices include VAT and all other taxes or levies that the Customer is obliged to bear. Business customers with a registered VAT number can, once logged in, view prices excluding VAT; the applicable amount is always shown at checkout.

If delivery, reservation or administrative costs are charged, this is stated separately. Delivery costs depend on the weight and dimensions of your order and are shown at checkout. From an order value of €50, standard delivery is free.

If for any reason the delivery costs turn out to be higher than those shown at checkout, DW Shop will inform the Customer by e-mail. The shipment will only be dispatched after the Customer has approved these costs by e-mail. The Customer may also cancel the order free of charge in that case.

The price stated relates solely to the articles as described in words. The accompanying photographs are decorative and may contain elements that are not included in the price.

Article 3: Offer

Despite the fact that the online catalogue and the e-commerce website are compiled with the greatest possible care, it is nevertheless possible that the information offered is incomplete, contains material errors or is not up to date. Obvious mistakes or errors in the offer are not binding on DW Shop. With regard to the accuracy and completeness of the information offered, DW Shop is only bound by an obligation of means. DW Shop is in no event liable in the case of manifest material errors, typing or printing errors.

Where the Customer has specific questions about, for example, sizes, colour, availability, delivery time or method of delivery, we ask the Customer to contact our customer service in advance on +32 474 27 67 47 or at info@dwshop.be.

The offer applies while stocks last and may be adapted or withdrawn by DW Shop at any time. DW Shop cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is subject to conditions, this is expressly stated in the offer.

Article 4: Online purchases

On the website you select the article you want, enter the quantity and click "Add to cart". You will find your shopping cart at the top right of every page. There you see an overview of the chosen products and quantities, you can adjust quantities or remove articles, and you proceed to checkout.

At checkout you enter your billing details, or you log in if you already have an account. You choose whether the shipment goes to the billing address or to another address, and then the delivery method: home delivery or delivery to a service point, insofar as those options are available for your country. You then choose a payment method and see an overview of your order for verification. Your order is only placed once you have confirmed that final step; you will then receive a confirmation on screen and by e-mail.

The Customer has a choice between the following payment methods:

  • Bancontact
  • iDEAL or Wero
  • Credit or debit card
  • Apple Pay
  • PayPal

Payments are processed through the secure environment of our payment partner. DW Shop does not store any card details itself.

DW Shop is entitled to refuse an order as a result of a serious shortcoming on the part of the Customer with regard to orders in which the Customer is involved.

Article 5: Delivery and performance of the agreement

DW Shop delivers to Belgium, the Netherlands, Luxembourg, France and Germany. Delivery to other countries is possible by arrangement with DW Shop.

As soon as we have received your payment, your parcel is dispatched as quickly as possible. If the product is in stock, it is generally shipped immediately.

For heavy articles or articles with unusual dimensions, an additional transport charge may apply. The Customer is informed of this in advance by e-mail and must approve these costs before the shipment is dispatched; the Customer may also cancel the order free of charge at that point.

The Customer may have the order delivered to their own address, to the address of a third party (with a clear statement of name and address) or to a service point, insofar as that option is available for their country.

DW Shop undertakes to deliver the ordered articles as quickly as possible. The average delivery time for products in stock is 1 to 7 working days. For products that are not in stock, a longer delivery time applies; where delivery will take more than a week, the Customer is informed of this by e-mail. For urgent orders it is best to contact us in advance to check availability.

Any delivery problem or damage must be reported within 24 hours of delivery on +32 474 27 67 47 or via info@dwshop.be.

We will then ensure that a new article is sent as quickly as possible. If, after inspection, the matter is covered by the guarantee, the shipping costs will be reimbursed by DW Shop where the article was returned using a transport label provided by DW Shop. If the matter is not covered by the guarantee, the return costs and the shipping costs for the new article are borne by the Customer.

We will inform you by e-mail of a delivery time that is as accurate as possible, or provide you with a track-and-trace code so you can follow the delivery status.

If you are not at home and the parcel is also not collected from the post office or service point, it automatically returns to us. Shipping and handling costs will then be charged again for a second delivery. The same applies where you provide an incomplete or incorrect delivery address. Please check your details carefully before placing your order.

Delivery is carried out by bpost or by DW Shop itself. Shipping costs depend on weight and dimensions. You can find more information on Shipping & Delivery.

Unless otherwise agreed or expressly stipulated, the goods are delivered to the Customer's home within 30 days of receipt of the order. Where a longer delivery period arises, DW Shop will inform the Customer.

Any visible damage and/or qualitative shortcoming of an article or other shortcoming upon delivery must be reported by the Customer to DW Shop without delay.

The risk of loss or damage passes to the Customer from the moment they (or a third party designated by them, other than the carrier) have taken physical possession of the goods. The risk passes to the Customer upon delivery to the carrier, however, where the carrier was instructed by the Customer to transport the goods and that choice was not offered by DW Shop.

Article 6: Retention of title

The delivered articles remain the exclusive property of DW Shop until the moment of full payment by the Customer.

The Customer undertakes to point out DW Shop's retention of title to third parties where necessary, for example to anyone seeking to seize articles that have not yet been paid for in full.

Article 7: Right of withdrawal

The provisions of this article apply only to Customers who, in their capacity as consumers, purchase articles online from DW Shop.

The Customer has the right to withdraw from the agreement within a period of 14 calendar days without giving any reason.

The withdrawal period expires 14 calendar days after the day on which the Customer, or a third party designated by the Customer other than the carrier, takes physical possession of the goods.

To exercise the right of withdrawal, the Customer must inform DW Shop, Brugsesteenweg 378, 8520 Kuurne, +32 474 27 67 47, info@dwshop.be, of their decision to withdraw from the agreement by means of an unambiguous statement (for example in writing by post or e-mail). The Customer may use the model withdrawal form for this purpose, but is not obliged to do so.

The Customer may also complete and send the model withdrawal form or any other clearly worded statement electronically via our website. If the Customer makes use of this option, we will send the Customer an acknowledgement of receipt of the withdrawal on a durable medium (for example by e-mail) without delay.

To meet the withdrawal deadline, the Customer must send their communication concerning the exercise of the right of withdrawal before the withdrawal period has expired.

The Customer must return or hand over the goods without delay and in any event no later than 14 calendar days after the day on which they communicated their decision to withdraw from the agreement to DW Shop, Brugsesteenweg 378, 8520 Kuurne. The Customer is in time if the goods are returned before the period of 14 calendar days has expired.

The direct costs of returning the goods are borne by the Customer.

If the Customer so wishes, we can collect the goods from the Customer. The costs of this are equivalent to the delivery cost. The products must be in the same packaging condition as at delivery; if this is not the case, the transport costs may be higher. The Customer must reimburse the collection costs to DW Shop before DW Shop instructs the transport company to collect the goods. The withdrawal form must be clearly completed and firmly attached to the return parcel.

If the returned product has diminished in value in any way, DW Shop reserves the right to hold the Customer liable and to claim compensation for any diminished value of the goods resulting from the Customer's handling of the goods beyond what is necessary to establish the nature, characteristics and functioning of the goods.

Only articles in their original packaging, together with all accessories, instructions for use and the invoice or proof of purchase, can be taken back.

If the Customer has requested that the performance of services begin during the withdrawal period, the Customer shall pay an amount proportionate to what has already been provided at the moment they informed us of their withdrawal from the agreement, compared with full performance of the agreement.

If the Customer withdraws from the agreement, DW Shop will reimburse all payments received from the Customer up to that moment, including standard delivery costs, within a maximum of 14 calendar days after DW Shop has been informed of the Customer's decision to withdraw from the agreement. In the case of sales agreements, DW Shop may withhold reimbursement until it has received all the goods back, or until the Customer has demonstrated that the goods have been returned, whichever occurs first, except where DW Shop collects the goods itself.

Any additional costs resulting from the Customer's choice of a delivery method other than the cheapest standard delivery offered by DW Shop are not reimbursed.

DW Shop reimburses the Customer using the same means of payment as the Customer used for the original transaction, unless the Customer has expressly agreed otherwise; in any event, the Customer will not be charged any costs for such reimbursement.

The Customer cannot exercise the right of withdrawal for:

  • Service agreements after the service has been fully performed.
  • The supply of goods or services for which the price is linked to fluctuations in the financial market over which DW Shop has no influence and which may occur within the withdrawal period.
  • The supply of goods made to the Customer's specifications, or which are clearly intended for a specific person.
  • The supply of goods that are liable to deteriorate rapidly or have a limited shelf life.
  • The supply of sealed goods that are not suitable for return for reasons of health protection or hygiene and whose seal has been broken after delivery.
  • The supply of goods which, after delivery and by their nature, are inseparably mixed with other products.
  • Agreements in which the Customer has specifically requested DW Shop to visit them in order to carry out urgent repairs or maintenance there.
  • The supply of sealed audio and video recordings and sealed computer software whose seal has been broken after delivery.
  • Agreements concluded at a public auction.
  • The supply of digital content not supplied on a tangible medium, where performance has begun with the Customer's express prior consent and the Customer has acknowledged that they thereby lose the right of withdrawal.

Article 8: Guarantee

The consumer benefits from the legal guarantee on consumer goods in accordance with the Belgian Code of Economic Law. This legal guarantee is two years and runs from the date of delivery. Any commercial guarantee leaves these rights unaffected.

To invoke the guarantee, the Customer must be able to present proof of purchase. Customers are advised to keep the original packaging of the goods.

For articles purchased online and delivered to the Customer's home, the Customer must contact DW Shop customer service and return the article to DW Shop.

On establishing a defect, the Customer must inform DW Shop as soon as possible. In any event, every defect must be reported within a period of two months after it has been established by the Customer.

Throughout the statutory guarantee period, a defect that manifests itself is presumed to have existed at the time of delivery, unless the contrary is proven.

The (commercial and/or legal) guarantee never applies to defects arising as a result of accidents, neglect, falls, use of the article contrary to the purpose for which it was designed, failure to observe the instructions for use or the manual, adaptations or modifications to the article, rough use, poor maintenance, or any other abnormal or incorrect use.

Article 9: Customer service

DW Shop customer service can be reached on telephone number +32 474 27 67 47, by e-mail at info@dwshop.be or by post at the following address: Brugsesteenweg 378, 8520 Kuurne. Any complaints may be addressed there.

Article 10: Sanctions for non-payment

Without prejudice to the exercise of other rights available to DW Shop, in the event of non-payment or late payment the Customer owes interest of 10% per year on the unpaid amount, by operation of law and without notice of default, from the date of the breach. In addition, the Customer owes, by operation of law and without notice of default, fixed compensation of 10% on the amount concerned, with a minimum of 25 euros per invoice.

In relation to consumers, these amounts apply only within the limits of the statutory provisions on late payment, and the consumer is, where applicable, entitled to equivalent compensation where DW Shop fails to meet its obligations.

Without prejudice to the foregoing, DW Shop reserves the right to take back articles that have not been paid for, or not paid for in full.

Article 11: Privacy

DW Shop is the controller and processes your personal data in accordance with the General Data Protection Regulation (Regulation (EU) 2016/679) and the Belgian legislation implementing it.

Your personal data is used for the performance of the agreement and the processing of your order, for delivery (the carrier must be able to contact you in the event of problems), for customer administration and accounting, and — only where you have given your consent — for sending newsletters or invitations to review a product.

You have the right of access, rectification, erasure and portability of your data, the right to withdraw your consent and the right to object to processing. You can object free of charge to the use of your data for direct marketing. Address your request to DW Shop, Brugsesteenweg 378, 8520 Kuurne, or info@dwshop.be. You also have the right to lodge a complaint with the Belgian Data Protection Authority, Drukpersstraat 35, 1000 Brussels.

We treat your data confidentially and do not pass it on, rent it out or sell it to third parties for commercial purposes. Personal data may, however, be passed on to parties that carry out necessary services for us, such as transport companies, the payment provider and our accountants.

The Customer is responsible for keeping their login details confidential and for the use of their password. Your password is stored in encrypted form; DW Shop has no access to it.

DW Shop keeps anonymous visitor statistics in order to see which pages of the website are visited and to what extent.

You can find more information in our privacy policy. If you have questions about these provisions, you can contact us at info@dwshop.be.

Article 12: Use of cookies

During a visit to the site, cookies may be placed on your computer or mobile device. A cookie is a text file placed by the server of a website in your browser when you consult that website. Cookies cannot be used to identify persons; a cookie can only recognise a device.

We use necessary cookies that make the website work — for example to remember your shopping cart, keep you logged in and save your language choice. These are indispensable and are always placed.

In addition, only where you give your consent, we use cookies for statistics and marketing. These allow us to measure how the website is used and to make our advertising more relevant.

On your first visit we ask for your choice via the cookie notice. You can change or withdraw your consent at any time via the cookie settings at the bottom of the website, and you can also manage or delete cookies yourself via your browser settings. Disabling cookies may mean that certain parts of the website do not work, or do not work correctly.

Article 13: Validity, non-waiver

If a provision of these Terms is declared invalid, unlawful or void, this will in no way affect the validity, lawfulness and applicability of the other provisions.

Any failure by DW Shop at any time to enforce one of the rights listed in these Terms, or to exercise any such right, will never be regarded as a waiver of that provision and will never affect the validity of those rights.

Article 14: Applicable law and competent court

All agreements between DW Shop and the Customer are governed by Belgian law. In the event of disputes, only the courts of the judicial district of West Flanders, Kortrijk division, have jurisdiction, without prejudice to the mandatory provisions applicable to consumers.

If you have a complaint, please contact us first via info@dwshop.be. We are happy to look for a solution together with you. As a consumer, you can also report a dispute via the European online dispute resolution platform: ec.europa.eu/consumers/odr.
